The Public Telephone Owners Association, Gunadala, Vijayawada, is the petitioner. By way of this writ petition, it seeks implementation of G.O.Ms.No.13, Information Technology & Communication Department, Communication Section, dated 10.01.2003 and a consequential direction to the respondent to extend the benefits, as allowed in respect of e-Seva centres in Urban Areas, and grant the same rate of commission to all Rural Service Delivery Points (RSDP) and also direct the banks to provide loans without any guarantee or security as agreed by them in the meeting held on 05.12.2002.

The respondent filed a counter-affidavit as long back as on 14.12.2004 stating that the target was to set up 2500 RSDP centres in Phase-I and as per the progress report submitted by the Commissioner, Youth Services, 964 centres had already been established all over the erstwhile State of Andhra Pradesh. He further stated that the commission to RSDP Operators varied from service to service and as per areas. The commission depended on the user department or the private agency on whose behalf the RSDP operators were rendering services to the citizens. This was stated to be the reason as to why the commission was not mentioned in G.O.Ms.No.13 dated 10.01.2003. He also denied the claim of the petitioner-association that RSDP operators were offering services on par with e-Seva centres. E-Seva centres were stated to be providing a number of services in urban areas with better ambience and greater infrastructure, whereas RSDPs were operated only in rural areas. He also adverted to the norms with regard to opening of bank accounts by RSDP operators.
3. Though time was granted to the petitioner-association to file its reply to this counter-affidavit, as long back as on 15.12.2004, no reply has been filed. In terms of the counter, it is clear that all possible steps were taken even in the year 2004 for implementation of G.O.Ms.No.13 dated 10.01.2003 and the claim of the petitioner- association for commission to be paid to RSDP operators on par with the commission payable to e-Seva centre operators was shown to be without basis. The respondent also indicated in the counter that no direction could be given to the banks as to security or guarantee. In any event, as no bank is impleaded in this writ petition, the above prayer cannot be considered.
4. The writ petition is accordingly dismissed. Pending miscellaneous petitions, if any, shall stand dismissed in consequence. No order as to costs.
