Supplementary affidavit filed today is taken on record. Heard learned counsel for the parties.
This is the second contempt application.
Earlier the contempt application (Contempt Application No. 5764 of 2016) filed by the applicant came to be dismissed as not maintainable on 19 December 2016. The instant contempt petition has been filed on the strength of the report submitted to the District Magistrate, Allahabad that some unauthorized possession of the opposite party is continuing on the suit property.
On hearing the parties at length serious disputed questions of facts are involved and it is admitted that a civil suit is pending.
In view thereof, I am not inclined to entertain the contempt petition. The contempt petition is, accordingly, consigned to record. Notice(s) discharged.
It will be open for the parties to raise their contentions in the pending civil suit.
