The petitioner has retired from the service of the 2nd respondent University as an Assistant Engineer on 30.4.2000 on superannuation. This original petition has been filed by him for a direction to the respondents to disburse his DCRG, arrears of salary etc.with interest.
2. Heard both the sides. The learned counsel for the petitioner submits that after filing this original petition, those claims have been disbursed to the petitioner but, no interest has been given. Now the grievance of the petitioner is only in respect of the interest payable for the delayed payment of his claims. He further submits that this original petition can be disposed of by granting an opportunity to the petitioner to approach the second respondent University with a representation claiming interest for O.P.No.24124 of 2001 2 the delayed payment of the amounts due to him. Having heard both the sides, this Court is also of the view that this original petition can be disposed of by granting an opportunity to the petitioner as suggested by the learned counsel for the petitioner.
3. In the result, the petitioner is granted liberty to submit a representation before the second respondent detailing his claim for interest for the delayed payment of the amounts within a period of thirty days from today. The second respondent shall dispose of that representation within a period of two months from the date of receipt of such representation from the petitioner. The second respondent shall afford an opportunity of being heard to the petitioner before disposing of such representation.
This original petition is disposed of as above.
