The petitioner, a stage carriage operator conducting services on the route Mattool-Kannur-Payyannur as a Limited Stop Ordinary Service with vehicle bearing Regn. No.KL 59/2799 has submitted Exhibit P5 application to the respondent. He complains that no action has been taken thereon, till date. 2. The petitioner is also conducting services on the route Payyannur-Kozhikode with another vehicle, stage carriage bearing Regn.No.KL 59C 9900. As per Exhibit P5, he has sought for interchanging the vehicles.
3. The learned Government Pleader on instructions submits that the replacement of a vehicle can be permitted only with a later model vehicle. If the petitioner's application is allowed that would result in permitting replacement of a later model vehicle with an older vehicle, which is not permissible.

3. Heard. Since Exhibit P5 application is pending before the respondent, I am not entering into the merits of the contentions advanced before me. It is sufficient that this writ petition is disposed of directing Exhibit P5 to be considered in accordance with law.
This writ petition is therefore disposed of directing the respondent to consider Exhibit P5 application submitted by the petitioner in accordance with law and to pass appropriate orders thereon, as expeditiously as possible and at any rate within a period of four weeks of the date of receipt of a copy of this judgment.
