Heard learned counsel for the petitioner, Sri M.N. Singh, learned counsel for the respondent nos. 1 and 2, Sri Rohit Pandey, learned counsel for the respondent no. 3 and Sri Dhananjay Awasthi, learned counsel for respondent no. 4.
The present writ petition has been filed for a writ of mandamus directing the respondent no. 1-Dr. Bhimrao Ambedkar University, Agra to send the name of petitioner institution to respondent no. 3 for participation in counseling for admission in B.Ed. Course in academic session 2019-2021 and permit the petitioner institution to avail benefit of counseling in respect of 100 seats as approved by National Council for Teachers Education (N.C.T.E.).
Learned counsel for the petitioner has submitted that he has been denied the opportunity of counseling for academic session 2019-2021 as he is having shortage of 13 teachers. To remove the deficiency and appoint teachers, petitioner has made an adverstisement in newspapers inviting applications and requested the University vide letter dated 24.4.2019 to appoint experts. University on 14.5.2019 provided the list of expert panel to conduct the interview of the candidates for appointment as teacher, but the expert so nominated are not fixing the date for interview on the ground that summer vacation is going on.
Sri M. N. Singh, learned counsel for the respondent nos. 1 and 2 on the instructions so received, has submitted that the petitioner may be directed to approach the University alongwith list of candidates to participate in the interview and the University shall make all arrangement to fix the date for interview within 2-3 days and in case deficiency of shortage of teachers is removed, his name may be recommended for interview.
Considering the facts and circumstances of the case, this petition is disposed of with liberty to the petitioner to approach the University and in case he approaches the University, Vice Chancellor shall make all arrangement to hold interview by providing experts in light of statement given by the counsel for the University.
Learned counsel for the University is directed to inform the Vice Chancellor and Registrar of the University about this order passed today within 24 hours.
