JUDGMENT / ORDER

The petitioner is aggrieved with Ext.P2, in which the petitioner's settled timings in a route was changed in accordance with Order No. D3/875/STA/2005 (D3 Circular) dated 08.11.2011, without notice and without hearing the petitioner. This Court has in W.P.(C) No. 2844 of 2013 found that D3 Circular implementation, even according to the Circular, has to be uniform; on a date specified by the State Transport Authority (STA). Prior to that intimation has to be received from all the Regional Transport Authorities as to settlement of timings as per D3 Circular. 2. In any event, the settled timings cannot be altered without hearing the permit holder. In view of the directions in the aforesaid judgment, Ext.P2 shall stand set aside and the petitioner will be permitted to operate on the earlier W.P.(C) No.9690 of 2014 - I 2 settled timings, as per the earlier time schedule; but subject to revision as per D3 Circular. The directions issued herein shall be subject to implementation of D3 Circular all over the State.
The writ petition is disposed of.
