JUDGMENT / ORDER

Petitioner was granted permit for quarrying. Ext.P6 is the permit. It is expired on 28.03.2007. The permit was originally granted to the petitioner's predecessor-in-interest. Petitioner applied for renewal. This was not considered for want of environmental clearance. Petitioner submits that his application can be treated as renewal of original application.
2. The application cannot be treated as a fresh application as predecessor was having permit by virtue of Ext.P6. Therefore the present application submitted by the petitioner can be treated as a renewal of Ext.P6. The third respondent is directed to consider the renewal application in respect of the same site mentioned in Ext.P6 for mining remaining area in Ext.P6. Needful shall be done within a period of three weeks without insisting for NOC or environmental clearance.
The Writ Petition is disposed of as above. No costs.
