P.Srinivasan vs The Principal Chief Conservator ...

Madras High Court|22 December, 2017

JUDGMENT / ORDER

The writ petitioner is running a Match Splint Industry. An order dated 28.10.2017 was passed by the second respondent directing the writ petitioner to stop of the operations. Therefore, this writ petition has been filed.
2.The learned Additional Government Pleader, appearing for the respondents brings to my notice that an identical proceeding issued in respect of another Unit was upheld in WP(MD)No.20526 of 2017 dated 08.11.2017. He therefore called upon this Court to dismiss the writ petition by following the said order dated 08.11.2017.
3.However, the learned counsel appearing for the writ petitioner would bring to my notice that there has been a subsequent development. The second respondent had sent a communication dated 27.11.2017 to the first respondent informing that the earlier proceeding dated 28.10.2017 has to be kept in abeyance. In other words, the second respondent has taken a stand that the present status quo obtaining on 27.11.2017 shall be maintained.
4.I am therefore of the view that the challenge in this writ petition has become infructuous since the order impugned in this writ petition is no longer holding the field. In view of the subsequent developments, no further adjudication is necessary. This writ petition is therefore closed as infructuous. No costs. Consequently, connected miscellaneous petition is also closed.
To
1.The Principal Chief Conservator of Forest, Tamil Nadu Forest Department, Panagal Maligai, Saidapet, Chennai.
2.The District Forest Officer, Office of the District Forest Officer, Tuticorin, Tuticorin District..
