P.S.Kennedy vs Ravikumar

High Court Of Kerala|04 November, 2014

JUDGMENT / ORDER

The limited prayer in this petition is for a speedy disposal of I.A. 907 of 2014 in O.S. 178 of 2014 whereby an exparte order of injunction has been passed against the petitioner herein.
2. The petitioner points out that he has filed a detailed written statement and also filed objection to the injunction application and the matter was posted for hearing on 6.7.2015.
3. It is trite that when exparte orders have been passed, within 30 days the matter will have to be considered on merits. Hence the request seems to be just and reasonable.
In the result, this Original Petition is allowed and the Munsiff's Court, Sasthamcotta is directed to consider and O.P.(C) 2539/2014.
. 2 dispose of I.A. 907 of 2014 in O.S. 178 of 2014 on merits and in accordance with law as expeditiously as possible, at any rate, within a period of 45 days from the date of receipt of a copy of this judgment.
