P.Shoba vs P.Padmavathy

Madras High Court|12 January, 2017

JUDGMENT / ORDER

The revision petition is filed by the plaintiff seeking a direction for disposal of final decree application in I.A.No.913 of 2016 in O.S.No.155 of 2010. Even on an earlier occasion, when the suit was pending, the plaintiff had moved this Court and taken a direction for speedy disposal of the suit. Accordingly, preliminary decree was passed in O.S.No.155 of 2010. Now, the final decree application is filed before the Sub-Court, Kancheepuram and the plaintiff is now seeking a similar direction for disposal of the final decree application. It is also stated by the very same learned counsel for the petitioner that there is only one Sub-Court in Kancheepuram, which is over-loaded with the work, and therefore, the progress is very slow. In such circumstances, this Court cannot issue specific direction to the learned Sub-Judge who is already over-burdened with work, to take and dispose of the case of the petitioner out of turn. However, considering the fact that it is only a final decree application, the learned Subordinate Judge, Kancheepuram is directed to dispose of I.A.No.913 of 2016 as expeditiously as possible. With this direction, the Civil Revision Petition is disposed of. No costs.
