The petitioner involved in a crime. The petitioner wants to go abroad since he is working abroad. Ext.P5 is the petition filed before the Judicial First Magistrate Court seeking permission to leave India. Ext.P6 is the order of the Magistrate permitting the petitioner to leave India. In fact, the petitioner's passport was seized by the Immigration Authority on arrival of the petitioner from abroad. The petitioner seeks return of the passport. 2. The learned Assistant Solicitor General submits that since the petitioner is involved in the crime, the Passport Authority cannot return the passport to the petitioner.
3. Considering the facts and circumstances of the case, I am of the view that the petitioner's passport shall be released to him. However, the period of validity in the passport shall be restricted for a period of three years from today. Passport W.P.(c).No.32282 of 2014 : 2 :
shall be returned to the petitioner forthwith.
The writ petition is disposed of as above.
