This Writ Petition has been filed for the issuance of a Writ of Mandamus, directing the respondents herein to extend the terms of the Board of Directors of the petitioner society, as sought for in the representation of the petitioner, dated 23.10.2009, made in pursuance of the resolution of the Board of Directors, dated 21.10.2009, till they conduct the election to the petitioner society.
2. Mr.Pala Ramasamy, the learned Special Government Pleader takes notice on behalf of the respondents. With the consent of both parties, the writ Petition is taken up for final disposal.
3. At this stage of the hearing of the Writ Petition, the learned counsel appearing on behalf of the petitioner had submitted that it would suffice, if the first respondent is directed to be dispose of the representation of the petitioner, dated 23.10.2009, on merits and in accordance with law, within a specified period fixed by this Court.
4. Mr.Pala Ramasamy, the learned Special Government Pleader, appearing on behalf of the respondent did not have any objection for such an order being passed by this Court.
5. In view of the submissions made by the learned counsels appearing on either side, without going into the merits of the case, the first respondent is directed to dispose of the representation of the petitioner, dated 23.10.2009, on merits and in accordance with law, within a period of ten days, from the date of receipt of a copy of this order. The Petitioner is directed to furnish a copy of the representation, dated 23.10.2009, along with a copy of this order, to the first respondent.
6. With the above directions, the Writ Petition is disposed of. Consequently, connected Miscellaneous Petition is closed. No costs.
