JUDGMENT / ORDER

ANTONY DOMINIC , J.
The petitioner is the Deputy Director of Prosecutions. By Annexure A1 order, he was transferred from Thiruvananthapuram to Kollam and in his place the 2nd respondent was posted, by transferring him from Calicut. The petitioner objected to the transfer, by filing a representation. The Tribunal by its order in O.A.No.327/2014 directed its consideration, keeping the order in abeyance. Accordingly, the matter was considered and the representation was rejected by the Government by Annexure A10 order. It was challenging Annexure A10, O.A.No.1390/2014 was filed by the petitioner. This O.A. was dismissed by the Tribunal by Exhibit P5 order. In this Original Petition, the petitioner challenges Exhibit P5 order.
2. We heard the learned counsel for the petitioner and the learned Government Pleader appearing for the 1st respondent.
3. Reading of Exhibit P5 order shows that the Tribunal has OPKAT.408/14 -2-
appreciated the merits of the rival claims and has taken a view that there is nothing unreasonable in having ordered the transfer of the petitioner. This view taken by the Tribunal is absolutely a balanced one and we do not think that it suffers from any arbitrariness or illegality, calling for interference in a proceedings under Article 227 of the Constitution of India.
The Original Petition is dismissed.
