The impugned order in this writ petition is arising from an order of surcharge ordered against the members of the Managing Committee of a Co-operative Society. The petitioners are 3 in number. The other members of the Managing Committee also have raised similar challenge in W.P.(C).No.25207 of 2007 wherein this court by judgment dated 20.9.2016 was pleased to quash Exts.P5 and P10.

In view of the fact that the issue in this writ petition is covered in favour of the petitioners in the light of the above judgment in W.P. (C).No.25207 of 2007, this writ petition is allowed by quashing and setting aside the impugned orders. No costs.
