1.0 Present appeal has been filed by the appellant - ONGC under Section 96 of the Code of Civil Procedure being aggrieved with the judgment and order passed in LAR No. 9 if 1986, by the Reference Court (learned Second Extra Assistant Judge) dated 26th February 1993 awarding rental and damages for temporary acquisition on the grounds stated in the application.
2.0 Heard learned counsel Ms. KJ Brahmbhatt.
3.0 In view of the smallness of the claim and considering the facts and circumstances of the case, present appeal deserves to be dismissed only on the ground of smallness of the claim without entering into the merits of the matter. Accordingly, present First Appeal stands dismissed.
