Heard learned counsel for the petitioner as well as learned counsel for the State.
The present writ petition has been filed by the petitioner for direction to the respondents to make polling booth in Panchayat Election village Khaera Kala, Tehsil Ekouna, District Shrawasti at the village itself.
Learned counsel for the petitioner submitted that he has given a representation to the District Magistrate in this respect, however, no action has been taken.
The question of making a polling booth at a particular place is exclusively within the jurisdiction of State Election Commission. Various aspects have to be taken into consideration while making the place as a polling booth.
This Court is not well equipped to decide the controversy regarding the creation of polling booth at a particular place. In view thereof, this petition is highly misconceived and is not maintainable and the same is hereby dismissed.
