Heard learned counsel for the petitioners, learned A.G.A. for the State and perused the materials available on record.
The corpus petitioners are said to have been detained by respondent no. 5 to 7, the private person who is said to be the brick kiln owner.
Respondent no.2, District Magistrate, Saharanpur, is hereby directed to inquire into the matter by an officer not below the rank of S.D.M. and if the corpus are recovered, they shall immediately produce them before the District Magistrate who shall pass the orders regarding their release in accordance with law. In case, he finds that the allegations made in the petition is false and frivolous then he may initiate penal inquiry against the petitioners and may impose a fine of Rs.10,000/- and if not suo-motu paid by them it shall be recovered as land revenue to be deposited to the fund of Legal Cell Authority, High Court, Allahabad.
The petition stands disposed of finally.
