This application has been filed to transfer the Suit No. 136 of 2019 (Rama Kant Goswami Vs. Priyanka) filed under Section 9 of the Hindu Marriage Act pending in the Court of Principal Judge, Family Court, Lalitpur to District Kanpur Nagar.
This application has been filed by the wife of the opposite party on the ground of convenience. It is stated in the affidavit filed in support of the application that the applicant is residing with her grand parents in Kanpur Nagar and the distance between the Lalitpur to Kanpur Nagar is 320 Kilometres and the applicant is facing great hardship in travelling from Kanpur Nagar to Lalitpur and she is compelled to stay at night in Lalitpur.
The grounds mentioned in the affidavit appears to be sufficient for transfer of the case. As per office report dated 25.11.2019, notice was issued to the opposite party by registered post fixing 4.11.2019 and the tracking report is that the notice has been delivered. Neither any vakalatnama nor any counter affidavit has been filed on behalf of the opposite party.
In view of the aforesaid, this transfer application is allowed and the aforesaid case being Suit No. 136 of 2019 (Rama Kant Goswami Vs. Priyanka) filed under Section 9 of the Hindu Marriage Act pending in the Court of Principal Judge, Family Court, Lalitpur is transferred to District Kanpur Nagar.
