The applicant is before this Court for a direction to initiate contempt proceeding against the opposite party for wilful disobedience of the judgement and order dated 10.12.2015 passed in Writ A No.38278 of 2015 (Priyanka Vs. State of U.P. and Ors.) and also the order dated 3.2.2020 passed in Contempt Petition No.651 of 2020 (Priyanka Vs. Devesh Chaturvedi & Ors.).
An affidavit of compliance was filed by the opposite party. It is stated in paragraph 5 of the affidavit of compliance that the order passed by the writ court has already been complied with and decision has been taken on 5.3.2021, copy of which is appended as annexure 1 to the affidavit, therefore, no cause of action remained survive.
In this view of the matter, Court is of the opinion that the order passed by the writ court has been complied with, therefore, no cause of action remained survive.
In view of the same, the present contempt application is dismissed. However, in case applicant is still aggrieved it is open for the applicant to approach the appropriate forum, if so advised.
