Heard Sri Niyaz Ahmad Khan(Senior Adv.), learned counsel for the petitioners, Sri Markanday Rai, learned counsel on behalf of respondent nos. 1 and 2 and Sri Sanjay Singh, learned AGA for the respondents 4, 5 and 6; and Sri Raj Kumar Verma (Father of the corpus) in whose custody the corpus currently is.
This habeas corpus petition has been filed by Rohan Kumar Soni seeking production of the corpus (Priyanka Verma).
On 21.10.2019, the Court had required the respondents to produce the corpus before the Court to ascertain whether the corpus would be willing to go with the petitioner no. 2 namely Rohan Kumar Soni.
Pursuant to order dated 21.10.2019 petitioner no. 1- corpus is present before the Court along with her father, who has been duly identified by counsel for the parties.
On being questioned, she has stated that she is aged about 25 years and not under any illegal detention or captivity of her father and has expressed her desire to go with her father namely Raj Kumar Verma (respondent no. 1) In view of the categorical statement made by the corpus-
Priyanka Verma, the present habeas corpus writ petition is dismissed.
The amount of Rs. 50,000/- deposited by the petitioner no. 2 shall be refunded to him by the registry of this Court after due verification through his counsel.
