Heard learned counsel for the petitioner and learned AGA for the State.
The petitioner, it seems, has been arrested in connection with Case Crime No.145 of 2020 under Sections 302, 307, 120-B IPC, Police Station Jaitpura, District Varanasi, as it surfaced during investigation that he had used his mobile, which is linked with the commission of crime.
The prayer made in the instant petition is for a mandamus commanding the Investigating Officer to collect his Mobile and CDR of his number and also consider his representation dated 21.10.2020.
Having regard to the nature of the grievance, we leave it open to the petitioner to approach respondent No. 2. He shall examine the grievance of the petitioner and do needful in the matter.
The writ petition is disposed of accordingly.
