Heard learned counsel for the applicant.
By means of this contempt application filed under section 12 of the Contempt of Courts Act, 1971 non-compliance of the order dated 22.7.2017 passed by the Sub Divisional Magistrate in exercise of its power under the U.P. Land Revenue Act, 1901 is compained of.
In the considered opinion of the Court, the Magistrate exercises its executive power in deciding mutation cases in summary way and may be quasi judicial in nature, is not a court within the meaning of Section 12 of the Contempt of Courts Act, 1971 to draw the proceedings under the Act of 1971.
It is always open to the applicant to pursue such remedy as may be available in accordance with law but no contempt lies.
Accordingly, the present application is consigned to records.
