Respondents This writ petition is filed under Article 226 of Constitution of India, praying to direct the respondent No.2 to refer answer scripts of Obstetrics Gynecology paper-2 bearing Q.P. No.1099 for revaluation (3rd Evaluation) in accordance with the orders Ordinance governing multiple valuation, dated 15.06.2012 vide Annexure-C dated 15.06.2012 and etc.
This writ petition coming on for Preliminary Hearing this day, the Court made the following:
ORDER The petitioner a medical student is before this Court seeking a writ of mandamus to the respondent-University to refer the answer sheets for third evaluation in terms of 2012 Ordinance of the University as has been held by this Court in W.P.No.48194-198/2018 vide judgment dated 21.12.2018.
2. Sri. N. K. Ramesh, learned Panel Counsel on request having accepted notice for respondent-University, submits that apparently although the present writ petition is similar to those in cognate writ petitions, still there is need for ascertaining the matchability of the factuals and therefore, liberty be reserved for undertaking the said exercise, if need be. The stand of the University is fair.
3. Subject to the liberty reserved as aforesaid, a Writ of Mandamus issues to the respondent-University to refer petitioner’s answer sheet (Obstetrics & Gynecology Paper-2 bearing Q.P.No.1099) for third evaluation in terms of paragraph No.26 of the judgment as aforesaid.
The compliance in three weeks. Accordingly, writ petition is disposed of. No costs.
