Heard learned counsel for the applicant, learned Additional Government Advocate for the State and perused the material available on record.
This application under section 482 Cr.P.C. has been filed by the applicant with a prayer for a direction to the court below to decide the Case No. 3910 of 2018 (State vs Shani Kumar and others) arising out of Case Crime No. 1 of 2018, under sections 498-A, 323, 504 and 506 IPC and section 3/4 of Dowry Prohibition Act, Police Station Mahila Thana, district Maharajganj pending in the court of learned Chief Judicial Magistrate, Maharajganj, as expeditiously as possible.
At the very outset, learned Additional Government Advocate has pointed out that charges have not been framed against opposite party Nos. 2 to 5.
Learned counsel for the applicant submitted that cognizance has been taken in this case on 09.07.2018, but on account of non- appearance of accused persons, no effective proceedings is going on.
After advancing some arguments at length, learned counsel for the applicant submitted that he does not want to press this application at this stage and he may be permitted to withdraw this application with liberty to file afresh application at the appropriate stage.
The prayer so made by learned counsel for the applicant is liable to be accepted.
In view of the above, present application under section 482 Cr.P.C. is rejected as withdrawn with liberty to file afresh application at the appropriate stage.
