Case called out in the revised list. None has appeared for the opposite party, although, a counter affidavit on behalf of opposite party and rejoinder affidavit on behalf of applicant are available on record.
I have heard Sri Ajay Sengar, counsel for the applicant.
By means of this transfer application, the applicant-wife seeks transfer of a divorce petition filed by the husband at Jalaun at Orai to District Raibareilly on the ground of convenience.
Additionally, in the affidavit filed in support of the transfer application, it has been averred that a case under Section 125 Cr.P.c. for maintenance has been filed by her against the husband which is pending consideration at Raibareilly.
This factum is not denied in the counter affidavit available on record.
In my considered opinion, all cases between the parties are better decided at one place for the sake of convenience of all concerned.
Accordingly, this transfer application is allowed.
Case No. 204 of 2018 (Rahul Prakash Vs. Smt. Priyanka Gupta) pending before the Principal Judge Family Court Jalaun at Orai shall stand transferred to District Raibareilly, forthwith.
