Heard learned counsel for the petitioner. Learned Standing Counsel has accepted notice on behalf of respondent no.1 and Shivam Yadav, learned counsel, has accepted notice on behalf of respondents no.2 and 3.
The petitioner has preferred present writ petition inter-alia with the prayer to direct the respondent no.1 to transfer the petitioner from District Muzaffarnagar to District Meerut or to decide the representation of petitioner dated 16.11.2021 (annexure no.8 to the writ petition) pending before respondent no.1.
It is argued by learned counsel for the respondents no.2 and 3 that in case petitioner will submit a fresh representation before the respondent no.1, he will look into the grievance of the petitioner.
Heard learned counsel for the parties.
With the consent of learned counsel for the parties, the writ petition is being disposed of at the admission stage itself.
In the facts and circumstances, the petitioner is permitted to make a fresh representation ventilating all her grievances before the respondent no.1/Principal Secretary, Basic Education Board, Government of U.P., Lucknow along-with certified copy of this order within a period of three weeks from today. If such a representation is made, the respondent no.1 is directed to pass appropriate order in accordance with law within a further period of two months.
With the aforesaid observations, present writ petition is disposed of finally.
It is made clear that this Court has not entered into the merits of the case and thus it is for authority concerned to take a decision independently in accordance with law.
