Heard Sri Pankaj Kumar Shukla, learned counsel for the petitioner, Sri Sanjay Kumar Singh, learned counsel for the private respondent and Sri Prabhas Pandey, learned brief holder for the State.
This writ petition has been filed with a prayer to quash the impugned F.I.R. dated 18.3.2018 registered as Case Crime No. 74 of 2018, under Sections 419, 420, 467, 468 and 471 IPC, P.S. Mutthiganj, District Allahabad.
Learned counsel for the petitioner submitted that the petitioner is the wife of respondent no. 4-Mohd. Nasir and there appears to be some matrimonial dispute between them for which an F.I.R. was lodged earlier by the petitioner against the husband. The present F.I.R. has been lodged against the petitioner by the husband.
Learned A.G.A. as well as learned counsel for the Caveator have opposed the prayer for quashing.
Considering the submissions advanced by learned counsel for the parties and nature of the allegations, it is directed that the petitioners shall not be arrested in above mentioned case, till the submission of the police report under section 173(2) Cr.P.C. but he shall co-operate with the investigation of the case.
With the above direction this petition is finally disposed of.
