Heard Sri Shyam Sudarshan, learned counsel for the applicant, learned A.G.A. for the State and perused the record.
This bail application has been moved by the accused-applicant Priyanka @ Pinki, who is involved in Case Crime No. 700 of 2017, under Section 302 IPC , Police Station - Gaura Badshahpur, District - Jaunpur.
As per prosecution version, on 24.09.2017 at about 08.30 A.M., an altercation took place between applicant, her husband co- accused Santosh Sonkar and deceased Sher Bahadur Sonkar, husband of informant Asha Devi. The applicant and co-accused Santosh Sonkar caused injury to Sher Bahadur Sonkar with bricks, due to which he died.
Learned counsel for the applicant contended that there is single injury on the person of the deceased. The applicant is a lady. There is no criminal history against her. She has been made accused falsely due to enmity. She is languishing in jail since 25.09.2017.
Per contra, learned A.G.A. has opposed the prayer for bail.
Perused the post mortem report. There is single injury to the deceased. The applicant is a lady.
Without commenting on the merits of the case, considering the facts and circumstances of the case, I find it a fit case for enlarging the applicant on bail.
Let the applicant - Priyanka @ Pinki be released on bail in the aforesaid case crime number on her furnishing a personal bond and two reliable sureties of the like amount to the satisfaction of the court concerned.
