Heard Mr.Asit B. Joshi, learned advocate for the petitioner. It is submitted by him that the impugned order dated 18.02.2008 passed by the Deputy Secretary (Appeals), Urban Development and Urban Housing Development Department, has been passed without issuance of notice for personal hearing the petitioner. It is further submitted that notice dated 23.06.2008 issued by respondent No.1 for personal hearing that was scheduled to take place on 17.07.2008, at Junagadh, was not delivered to the petitioner, but was delivered to another trust with a similar name. An affidavit to this effect has been sworn by the President of the other trust, that bears the name "Priyadarshini Education and Charitable Trust", whereas the petitioner-Trust is the "Shri Priyadarshini Education Trust". It is submitted that it was only after the petitioner came to know of the passing of the impugned order that inquiries were made, and the affidavit was sworn by the other trust.
