The supplementary affidavit filed today is taken on record.
Heard Shri Kaushlendra Singh, learned counsel for the petitioner and Shri Rajesh Kumar Srivastava, learned Standing Counsel for the respondents.
The petitioner is before this Court with request to issue direction to the respondent nos.2 and 3 to demarcate her abadi land in accordance with law and restore physical possession of her abadi land situated in Village Kakardahi, Tehsil Maitha, Police Station Shivli, District Kanpur Dehat within stipulated time.
Shri Rajesh Kumar Srivastava, learned Standing Counsel has raised objection that full fledged mechanism is provided under Section 24 of U.P. Revenue Code, 2006. In case any such application is moved by the petitioner, then definitely the authority concerned will proceed and pass final order.
No useful purpose would be served in keeping the writ petition pending.
In the facts and circumstances, with the consent of parties, this petition stands disposed of finally with observation that in case the petitioner moves an appropriate application before the Sub Divisional Magistrate, Maitha, District Kanpur Dehat strictly in accordance with law within two weeks from today, then definitely the authority concerned will proceed and decide the matter in accordance with law after affording opportunity of hearing to all the stake holders, as expeditiously as possible and preferably within three months from the date of production of certified copy of this order.
