By means of the present petition, the petitioner is seeking to challenge the order dated 7.4.2018 passed by the Tehsildar Mugal Sarai (Chandauli), whereby the petitioner has been assigned work of Lekhpal Area Kori in place of Dulhipur. The change of duties is within the same Tehsil.
The contention of learned counsel for the petitioner is that the said adjustment has been made in order to accommodate one Gopal Singh, who was earlier posted for continuous period of 10 years in Tehsil Sakaldiha and has again been adjusted.
The submission of learned counsel for the petitioner raising allegation against the competent Authority cannot be accepted as no one has been impleaded by name.
Even otherwise, it is noteworthy that the adjustment of the petitioner on the post of Lekhpal is in such a manner that now he has been assigned another Lekhpal Area in the same Tehsil, which cannot be said to be a transfer rather it is the arrangement of administrative duties by the competent authority.
In view of above noted reasons, this Court does not find any justification to interfere with the impugned order. The petitioner is hereby directed to join the new place of posting. Learned counsel for the petitioner, at this stage, submits that the petitioner has already handed over the charge of the Lekhpal Area Dulhipur but has not joined at the new Lekhpal Area.
Be that as it may, it is directed that the petitioner shall first join the Lekhpal Area Kori which has now been assigned to him and then make a representation before the respondent no.2, who may consider the grievances of the petitioner in accordance with law.
In view of above, writ petition is, accordingly, disposed of.
