Heard learned counsel for the petitioner and learned A.G.A. for the State.
Petitioner has made following prayers:-
(i) issue a writ, order or direction in the nature of certiorari quashing the impugned F.I.R. dated 5.12.2020 registered as Case Crime no. 1008 of 2020, under Sections 363, 366 IPC, P.S. Etmaddaula, District Agra.
(ii) ) issue a writ, order or direction in the nature of mandamus directing the respondent no. 2 and 3 not to take coercive measures against the petitioners in connection of the impugned F.I.R. dated 5.12.2020 registered as Case Crime no. 1008 of 2020, under Sections 363, 366 IPC, P.S. Etmaddaula, District Agra during the course of investigation of the aforesaid case.
(iii) issue a writ, order or direction upon the learned court below as this Hon'ble Court may deem fit and proper under the facts and circumstances of the case.
Learned counsel for the petitioner states that the petitioner shall file legible copy of Juvenile Health Card (Page-40). The girl Priya Pal is said to be 18 years. In that view of the matter, if the petitioner appears before the court below praying for bail, his bail application shall be considered as expeditiously as possible within a period of four weeks from the date of filing of the application.
With the aforesaid observations, petition is disposed of.
The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad, self attested by the petitioners along with a self attested identity proof of the said person (s) (preferably Aadhar Card) mentioning the mobile number (s) to which the said Aadhar Card is linked.
The concerned Court/Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
