The applicant has preferred the present contempt application for non-compliance and willful disobedience of the judgement and order dated 03.05.2017 passed in Application Under Section 482 No.13749 of 2017 (Prithviraj Vs. State of U.P. and others).
Today when the matter is taken up, a prayer has been made by the learned counsel for the applicant to adjourn the matter.
It appears from perusal of the order-sheets that as and when the matter was taken up, the adjournment was sought by the learned counsel for the applicant. It further reveals from perusal of the record that the present contempt application has been filed for non-compliance of the aforesaid order which is an interim order of status quo till the next date of listing. It further appears from perusal of the order dated 12.08.2021 and 13.08.2021 passed in the Application Under Section 482 Cr.P.C., the order of status quo has not been extended. Further, nothing has been stated in the entire contempt application that whether any counter affidavit or stay vacation application has been filed in the matter or not by the opposite party/respondent.
In this view of the matter, this court is of the opinion that since the order of status quo has not been extended, therefore, no case of contempt has been made out.
Accordingly, the present contempt application has been dismissed.
