Heard Sri Narsingh Pandey, learned counsel for the petitioner and Sri Ram Lakhan Devbansi, learned Standing Counsel.
The aforesaid writ petition was taken up on 11.6.2019 and the Court directed the learned Standing Counsel to seek instructions in the matter. Today, when the matter has been taken up, learned Standing Counsel on instructions states that the Will in favour of respondent Ram Saran is a registered Will, whereas the Will in favour of the petitioner is a unregistered Will and the petitioner has made a false statement in paragraph no. 6 of the writ petition that Dayaram on 4.4.2003 had executed a registered Will in favour of the petitioner.
The aforesaid submission of the learned Standing Counsel is not disputed by learned counsel for the petitioner.
However, after some arguments, learned counsel for the petitioner submits that he does not want to press the writ petition.
Consequently, the writ petition is dismissed as not pressed.
