Heard learned counsel for the applicants and learned A.G.A. for the State. The accused-applicants Prithvi Loniya, Guddu Loniya, Babadeen and Naumi Lal are involved in Case Crime No. 789 of 2009, under Sections 3 (1) U.P. Gangsters and Anti Social Activities (Prevention) Act, from Police Station Mohammadpur Khala, District Barabanki.
The submission of learned counsel for the applicants as per gang chart four criminal cases have been shown against the accused applicant no.1 Prithvi Loniya. Two criminal cases have been shown in the gang chart against each of the accused applicant nos. 2, 3 and 4, namely, Guddu Loniya, Babadeen and Naumi Lal. Two cases against Prithvi Loniya are under Section 3/25 Arms Act which is not covered under the Gangster Act. All the accused applicants are on bail in all the cases. Therefore, accused applicants also deserve to be released on bail in this case too.
Learned A.G.A opposed the bail application.
Considered the submissions of the learned counsel for the applicants and the learned Additional Government Advocate. Keeping in view the totality of the facts and circumstances of the case, without expressing any opinion on the merits of the case, accused applicants may be released on bail. Let applicants Prithvi Loniya, Guddu Loniya, Babadeen and Naumi Lal be released on bail in aforesaid case crime number on their furnishing a personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
