The petitioners are the Principal and the Committee of Management respectively of Jai Bajrang Mahila Mahavidyalaya, Mungarabadshahpur, Jaunpur. The said institution is duly recognised for imparting instructions in B.Ed. The case of the petitioners is that in pursuance of the Press Release issued by Lucknow University on 12.7.2017 permitting private institutions to fill up vacant seats by 15.7.2017, the petitioners' institution had taken admission of 15 students directly by the prescribed cut off date. These students were also permitted to appear in first semester examination. However, their result has not been declared so far. The second semester examination is scheduled to be held from 8.5.2018. The petitioners apprehend that these students would again not be permitted to appear in the examination.
Sri Vivek Verma, learned counsel appearing on behalf of respondent no.3 submitted that the respondent University would have no objection in permitting these students to appear in the examination provided their admissions are verified as lawfully made by the counselling University i.e. the second respondent.
Sri Mohit Singh, learned counsel appearing on behalf of the second respondent submitted that in case the petitioners approach the second respondent, he would examine the validity of the admissions relating to 15 students and would pass necessary orders.
Having regard to the submissions made, the instant petition is disposed of with liberty to the petitioners to approach the second respondent within three days from today alongwith certified copy of this order and in which event, the second respondent shall examine the claim of the petitioners in respect of 15 students admitted by the petitioners' institution directly by passing a speaking order within next one week.
