Shri Ramesh Chandra Dwivedi, learned counsel appearing on behalf of the petitioner submits that petitioner who is the principal of the Nehru Intermediate College, Kushinagar has approached this Court seeking direction to the District Inspector of Schools, Kushinagar to pass an appropriate order on the communication dated 10.4.2019 regarding the suspension of respondent no.4.
Learned counsel for the petitioners submits that D.I.O.S. has to pass an order in terms of Section 16G (7) of the U.P. Intermediate Education Act, 1921 (hereinafter referred as 'the Act of 1921') read with Regulation 39(2) of Chapter III of the Act of 1921, however till date, not order is passed.
Learned counsel appearing on behalf of D.I.O.S. has not disputed the legal position as mentioned above.
In view of the above, this writ petition is disposed of with the direction to the District Inspector of Schools, Kushinagar to pass an appropriate order on the communication dated 10.4.2019, under the provisions mentioned above, preferably, within a period of two weeks from the date of production of a certified copy of the order.
