Supplementary affidavit filed today is taken on record.
By means of the present writ petition under Article 226 of the Constitution, petitioner has approached this Court for a direction to the District Magistrate to take a decision on the complaint of the petitioner made under U.P. Panchayat Raj (Removal of Pradhans, Up-Pradhans and Members) Enquiry Rules, 1997.
It is alleged that though a copy of the complaint was sent by the registered post, a photocopy of the postal receipt whereof has been annexed along with the writ petition, the same has not been received back undelivered and, therefore, it shall be deemed that the representation has been duly served upon the District Magistrate, Azamgarh.
In view of the above facts and circumstances of the case, it is hereby directed that in the event the said complaint has been received in the office of District Magistrate as per the format prescribed under the 1997 Enquiry Rules, the District Magistrate shall proceed to pass appropriate orders on the said complaint and the said decision shall be taken by him regarding entertainment of the complaint by the petitioner within a period of three months from the date of production of certified copy of this order.
With the aforesaid observations/ directions, the writ petition stands disposed of.
