JUDGMENT / ORDER

Petition filed under Section 438 Cr.P.C. 2. Petitioner is the second accused in Crime No.665/14 of Parippilly Police Station registered for the offences under Sections 143, 147, 148, 323, 324, 506(1) read with 149 IPC.
3. Petitioner was a student. The defacto complainant also was a student in the same college. It is alleged that the petitioner along with the co-accused assaulted the defacto complainant with stones at the gate of the college. The number of the offenders was about 20. It is submitted by the learned counsel for the petitioner that the petitioner is not involved in any other case and he may be granted anticipatory bail.
4. Heard the learned counsel for the petitioner and the learned Public Prosecutor.
5. From the order of the lower court produced by the petitioner, it is seen that the defacto complainant sustained injuries on the head and all over the body. Prima facie, the petitioner has committed the offences alleged against him. The mere fact that he is B.A.No.2877 OF 2014 :: 2 ::
a student, which is the only ground urged in the petition, it is not proper to invoke the jurisdiction of this Court under Section 438 Cr.P.C. Criminal activities in colleges cannot be tolerated. Such tendency on the part of students should be nipped in the bud itself. I am not inclined to grant the relief prayed for in the application.
In the result, this Bail Application is dismissed.
