This petition for writ is preferred to have appropriate writ, order or direction for respondents to evolve uniform policy for administering primary/secondary institutions on the grant-in-aid list in fulfillment of their duties under the Right to Free and Compulsory Education Act, 2009.
Manish Goyal, Additional Advocate General assisted by A.K. Goyal, Additional Chief Standing Counsel have brought to our notice that a uniform policy has already been framed and notified by the Government of Uttar Pradesh under the Office Memorandum dated 14th July, 2020, available on record as Annexure No.8.
A perusal of the document aforesaid discloses that Government has already adopted a policy to allow grant-in-aid to educational institutions looking to their level of standards and such aid is confined to the institutions already in operation. A definite decision is taken for not placing any new private school on the list for grant-in-aid.
In view of the policy already adopted under the Office Memorandum dated 14th July, 2020, we are not inclined to interfere in the matter. However, it is expected from the Government of Uttar Pradesh that the policy aforesaid shall be strictly applied and enforced in the State.
The writ petition with the observations above stands disposed of.
