JUDGMENT / ORDER

Heard the learned counsel for the petitioner and the learned Government Pleader for respondents 1 to 5, apart from perusing the record. Since the issue lies in a narrow compass, this Court proposes to dispose of the writ petition at the admission stage itself. 2. Briefly stated, the petitioner had an approved appointment as Lower Primary School Assistant on 13.06.1989 in a school under the management of the 6th respondent. In course of time, the 6th respondent purchased three other aided schools. Consequently, by virtue of Rule 35 of Chapter XIV A of KER, a common seniority list was prepared through Ext.P1, which was duly approved by the 3rd respondent.
3. As could be seen from the record, when a maternity leave vacancy arose in one of the schools under the W.P.(C) No. 28387/2014 -2-
management of the 6th respondent, the petitioner, being the senior most teacher, was promoted as High School Assistant (Social Science). Having worked from 01.12.20111 to 01.03.2012 as HSA, later the petitioner was relieved and permitted to join back as LPSA in the parent school. The authorities, however, did not approve the appointment of the petitioner as HSA stating that there was no material to prove that all the schools were under the single management. Thus, an order of rejection came to be passed through Ext.P9 by the 4th respondent. Assailing Ext.P9, the petitioner filed Ext.P11 revision before the 5th respondent Government. Complaining of its non-disposal, the petitioner filed the present writ petition.
In the facts and circumstances, having regard to the respective submissions of the learned Counsel for the petitioner and the learned Government Pleader, without expressing any opinion on the merits of the matter, this Court disposes of the writ petition with a direction to the 5th respondent to consider Ext.P11 revision petition in accordance with law and pass W.P.(C) No. 28387/2014 -3-
appropriate orders thereon, as expeditiously as possible, at any rate, within four months from the date of receipt of a copy of this judgment. No order as to costs.
