1. The applicant - association has taken out present application seeking below mentioned relief:
"3(a) to direct/permit withdrawal of the main petition being SCA No.2747/2005 in so far as the following 5 (five) Primary Teachers are concerned, namely, (1) Saikh Abdul Kadir Yusuf, R.K.Colony Primary School, (2) Mohmed Faruk Yusuf Jiva, R.K.Colony Primary School, (3) Pathan Zarinabanu Ahmed, R.K.Colony Primary School, (4) Munshi Johrabibi Gulam Hushen, Kholvad Primary School and (5) Mehta Sureshchandra Bhanabhai, Umbhel Primary School."
2. The five members of the applicant - Association seek to be deleted as petitioners from the petition being Special Civil Application No.2747 of 2005 and they want to withdraw themselves as petitioners from the said petition and to withdraw their claim as petitioners from the said petition. The names of the petitioners who have made the request are as under:
(1) Saikh Abdul Kadir Yusuf (Sr.No.29 at Page No.27 in SCA No.2747/2005) (2) Mohmed Faruk Yusuf Jiva (Sr.No.32 at Page No.28 in SCA No.2747/2005) (3) Pathan Zarinabanu Ahmed (Sr.No.33 at Page No.28 in SCA No.2747/2005) (4) Munshi Johrabibi Gulam Hushen (Sr.No.6 at Page No.25 in SCA No.2747/2005) (5) Mehta Sureshchandra Bhanabhai (Sr.No.1 at Page No.23 in SCA No.2747/2005)
3. The said five persons are the members of the applicant - petitioner association. The said five persons have placed on record, as annexures to this application, separate and individual affidavits declaring their wish and decision to withdraw themselves as petitioners from the said petition and to withdraw their claim as petitioners from the said petition. The respondents do not have any objection. Therefore, the application is allowed in terms of para 3(a). Accordingly, application stands disposed of.
