JUDGMENT / ORDER

HON’BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL REVISION CASE No.2359 OF 2014 ORDER:
The present application is filed under Section 397 and 401 CrPC, questioning the order dated 06.08.2014 passed in Crl.M.P. No. 588 of 2014 in Crl.A. No.499 of 2014 on the file of the V Additional Metropolitan Sessions Judge, Mahila Court at Hyderabad.
The main ground urged by the learned counsel for the petitioner that the quantum of maintenance awarded is on the higher side and as such it is difficult for him to pay the said amount. He further submits that he was not given an opportunity to cross-examine the witnesses during the trial. The issue as to the prejudice caused to the petitioner in not cross-examining the witnesses can be agitated in the appeal. However, the appellate court while admitting the appeal, granted stay of the trial court order with regard to payment of compensation of Rs.5,00,000/-, return of Rs.1,00,000/- dowry, 40 tolas of gold and other household articles.
Since there is no dispute with regard to relationship between the petitioner and paternity of respondents 3 and 4 herein, the impugned order appears to be just and reasonable warranting no interference.
Accordingly, the criminal revision case is dismissed. However the lower appellate court shall dispose of the Criminal Appeal No.499 of 2014 as expeditiously as possible preferably within a period of four months from the date of receipt of the copy of this order.
