Heard counsel for the petitioner and learned standing counsel.
The present writ petition has been filed praying for a direction in the nature of mandamus commanding the respondent no. 1- Commissioner, Azamgarh Division, Azamgarh to decide appeal no. 370/BC-2018150000000018 of 2017-18, Premshanker Pandey Vs. D.S.O., Ballia preferred under clause 13 (1) of the U.P. Essential Commodities (Regulation of Sale and Distribution Control) Order, 2016.
It is submitted by the counsel for petitioner that against the order dated 25.10.2017 passed by the S.D.O., Ballia cancelling his licence of fair price shop, the petitioner has preferred aforesaid appeal on 16.11.2017 which is still pending before the respondent no. 1. It is prayed that a suitable direction may be issued to respondent no. 1 to decide the appeal within some stipulated period.
In the facts and circumstances of the case, the respondent no. 1- Commissioner, Azamgarh Division, Azamgarh is directed to decide appeal filed by the petitioner in accordance with law expeditiously within three months from the date of production of a certified copy of this order.
With the above direction, the writ petition stands finally disposed of. No order as to costs.
