Heard learned counsel for the applicants as well as learned A.G.A. for the State.
This application under Section 482 Cr.P.C. has been filed for quashment of the entire proceedings of Complaint Case No. 2017 of 2018 Ulfat Vs. Prempal and others, under Section 406 I.P.C. and Section 4 D.P. Act, P.S. Ughaiti, District-Badaun, pending in the Court of the learned Additional Chief Judicial Magistrate-I, Budaun as well as to quash the impugned summoning order dated 28.2.2019.
At the very outset on the proposal of the Court, it has been submitted by learned counsel for the applicant that the present matter can be well considered by the Mediation Centre of this Court for amicable settlement of the dispute.
The matter is remitted to the Mediation Centre with the direction that the Mediation Centre shall conclude the mediation and conciliation proceedings expeditiously, preferably within a period of two months after giving notices to both the parties.
It is directed that applicants shall deposit a sum of Rs.20,000/- within fifteen days from today with the Mediation Centre of which 80% shall be paid to opposite party no.2 for his appearance before the Mediation Centre.
List this case after expiry of the aforesaid period.
Till the next date of listing, no coercive action shall be take against the applicant in the aforesaid case.
It is expected that both the parties along with their counsels will present themselves in the mediation and conciliation centre of this Court to explore all possibilities of reaching amicable and viable solution of their differences.
After depositing the amount, aforesaid, notices shall be issued to the parties and in case the aforesaid amount is not deposited within the aforesaid period, this application shall stand dismissed automatically.
