Petitioner's husband was a class IV employee in UP Police, who died in harness on 7.11.2014. An application for grant of compassionate appointment has been moved by the petitioner, who is wife of deceased employee.
The record reveals that petitioner has already been offered appointment on class IV post vide order dated 9.7.2018. Petitioner instead of joining on the post has filed the present writ petition for a direction upon the respondents to appoint the petitioner on the post of Workshop Hand or any other suitable class III post. Admittedly, petitioner's husband was class IV employee and she has also been offered appointment to a class IV post. Compassionate appointment cannot be claimed as a matter of right inasmuch as it is merely an exception to the recruitment rule to meet out the difficulties created on account of sudden death of the sole bread earner. Petitioner may either accept the appointment offered or leave it. No interference in the matter is called for in exercise of jurisdiction under Article 226 of the Constitution of India.
Writ petition is, accordingly, dismissed.
