Heard Sri Bhanu Pratap Singh along with Sri Ratish Sengar on behalf of the petitioner; Sri Ashutosh Dwivedi, Advocate, holding brief of Sri Baleshwar Chaturvedi, learned counsel appearing for respondent-Corporation and; learned Standing Counsel for the State-respondent.
Submission of learned counsel for the petitioner is, on one hand, respondents have not regularized her electric connection and, on the other, they have not adjusted the amount Rs. 3,000/- paid by her. At the same time, they have disconnected her electricity connection and are demanding payment of Rs. 85,701/-.
Upon hearing the parties, it appears that a decision is yet to be made by the respondents on the prayer for regularization of the electric connection, made by the petitioner. Also, a final view has to be taken by the respondent no.4 as to the correct amount due.
In view of above, no useful purpose would be served in keeping the present petition pending or calling for counter affidavit. Present writ petition is disposed of with the following directions:
(i) In case the petitioner files a copy of this order before the respondent no.4 within a period of two weeks from today along with a deposit of Rs. 15,000/-, the said respondent shall take up for consideration the petitioner's prayer for regularization of her energy connection under the scheme dated 21.10.2019, which was admittedly in force till 31.3.2020. Direction has become necessary as in the prevailing circumstances, difficulties and disabilities being faced by the citizen, cannot be ignored.
(ii) Upon the deposit being so made, respondent no.4 shall also energize the electricity connection of the petitioner on temporary basis, within a period of two weeks from the deposit being made.
(iii) Further, the said respondent shall proceed to determine the exact amount of dues payable by the petitioner, which may be paid out in four equal monthly installments payable on or before 31 August 2021, 30 September 2021, 31 October 2021 and 30 November 2021 respectively.
Subject to the aforesaid payments being made, the electricity connection that may have been energized on temporary basis, shall be made permanent and no recovery charges may be pressed against the petitioner.
