Heard learned counsel for the applicant and learned A.G.A for the State.
The instant anticipatory bail application has been filed on behalf of the applicant, Prema Devi, with a prayer to release her on bail in Case Crime No.107 of 2020, under Sections-147, 148, 323, 325, 506, 308 I.P.C., Police Station-Gambheerpur, District-Azamgarh, during pendency of trial.
Charge-sheet has already been submitted in this case. The material collected by the Investigating Officer has not been brought on record.
In view of paragraph 45(1) of the judgement dated 05.04.2021 passed by this Court in Criminal Misc. Anticipatory Bail Application u/s438 Cr.P.C No.2110 of 2021, Shivam Vs. State of U.P. and another, this anticipatory bail application is not maintainable.
It is, accordingly, rejected.
