Heard counsel for the petitioner; Shri Arvind Kumar Goswami for the respondent no. 1 and the learned Standing Counsel for the respondent nos. 2 and 6 and perused the record.
According to the petitioner, a crop loan was taken by him from the Bank of Baroda. The petitioner insured the crop by allowing deduction of Rs. 1419/- in his account. But, when a claim on failure of crop was made, it was found that the insurance premium was not paid to the insurance company. Thereafter, the petitioner agitated the matter with the concerned bank. The bank informed the petitioner that the concerned company had returned the demand draft and, therefore, the premium could not be paid. In that background, the petitioner made a complaint before the Reserve Bank of India for taking action against Bank of Baroda.
From the documents brought on record, it appears that the Reserve Bank of India has informed the petitioner by letter dated 6.6.2018 that as the complaint of the petitioner was not as per the provisions of the Banking Lokpal Yojna- 2006, no action could be taken on the complaint of the petitioner. Subsequently, the petitioner was also informed by letter dated 15.3.2019 that if he is aggrieved by the conduct of the bank, he may take recourse to the appropriate legal remedy before the appropriate legal forum.
In this petition, the prayer of the petitioner is only against the Reserve Bank of India and not against the insurance company or the Bank of Baroda.
As it not been demonstrated as to how the Reserve Bank of India can help the petitioner in respect of his grievance, no relief can be granted to the petitioner in this petition. The petition is dismissed without prejudice to the right of the petitioner to take recourse to the appropriate legal remedy before appropriate forum.
