Heard learned counsel for the petitioner and Sri Sharad Chandra Srivastava, learned Standing Counsel who represents all the respondents.
With the consent of learned counsel for the parties, the writ petition is disposed of at the admission stage.
The contention of the counsel for the petitioner is that a representation/ application is filed on 29.05.2017 before the respondent no.3 with a prayer to enter/restore the name of petitioner in revenue record in Gata No.2474 area 2215.75 square meter, Gata No.2264 area 202.35 square meter, Gata No.2263 area 323.76 square meter and Gata No.2259 area 56.59 square meter total area 2798.13 square meter situated in village Lakadi Fazalpur, Tehsil Sadar, District Moradabad.
The claim of the petitioner is that vide the order dated 23.05.2017 passed by the Saksham Pradhikari, Nagar Bhumi Seemaropan, Moradabad in Case No. 1336/3933 (State vs. Janki) the proceedings are allowed in favour of the petitioner.
Having heard the learned counsel for the parties, the writ petition is disposed of by directing the respondent no.3 to consider and decide the petitioner's application/ representation dated 29.05.2017 in accordance with law after providing opportunity to the respective parties preferably within a period of four months from the date of production of the certified copy of this order.
It is made clear that this Court has not adjudicated upon the merits of the claim as raised by the petitioner in the present writ petition.
